BASIC PRINCIPLES WE FOLLOW WHEN WE COLLECT PERSONAL DATA:

We at INTERCAPITAL MARKETS AD are aware of the responsibility we carry for the security of your personal data. We always aim to process and manage your personal information in a transparent manner, that is why we observe the following principles:

• We process your personal data for the purposes pointed out in this Privacy Policy declaration; or for specific purposes that we have expressly shared with you; or for the purposes for which you have given your consent;

• We strive to collect the minimum data we need;

• To keep your personal data accurate and up-to-date;

• When we no longer need your personal data, we delete or anonymize it so that it does not allow your identity to be identified.

WHAT KIND OF PERSONAL DATA WE COLLECT AND PROCESS?
In the course of our special investment activity, we process different types of personal data according to the categories below. Depending on the specific products and/ or services in connection with which we have a contractual relationship, we process some or all of the data below.

Category of personal information about customers:

• physical identity: three names, personal identification number/ personal number of foreigner (or other identification number), date and place of birth, address, copy and data of identity document, nationality, country of residence; if the client is a foreign person - similar identification data;

• economic identity: participation and/ or holding of securities of companies, bank account, information of the source and amount of regular income, assets, including liquid assets, investments and real estate, regular financial liabilities, and other relevant information applicable to the European and national regulations;

• professional experience and knowledge in the field of investment activity: education, qualification, employment, work experience and knowledge in the financial sphere and trade in financial instruments, investment goals, nature, volume, period and frequency of transactions and other information in accordance with the applicable European and national regulations;
• data for identification and assessment of money laundering risk and financing of terrorism: information about the client and the client's representative, origin of the property, transaction counterparties, business activities, real owner, if the client is prominent political figure in relation to the LMML and LMFT, etc .;

• VAT number and tax jurisdiction;

• register with the telephone conversations with clients according to the requirements of the delegated Regulation (EU) 2017/565 and the applicable national regulation;

• contact data such as address, phone number, e-mail;

• history and information related to the services we had provided to you.

• history and information in connection with the contracts concluded with you.

THE PERSONAL DATA WE COLLECT ARE PROCESSED ONLY FOR THE FOLLOWING PURPOSES:

The purposes of processing personal data are related to identify our clients, performing a assessment of an appropriate service, and meeting all other applicable regulatory requirements.

In particular, these purposes include the following:

• for identification of persons according to the regulatory requirements;

• providing appropriate investment products and services and risk assessment to clients;

• classification of the client as professional or non-professional;

• determining the tax status of the client for the purposes of the automatic exchange of financial information in the field of taxation;

• fraud prevention and money laundering;

• concluding and executing contracts with clients;

• preparing and sending invoices and other accounting documents to clients;

• correspondence with clients about the products and services provided, sending various notices, marketing messages, news, notification of problems, errors or to respond to your requests, complaints and suggestions;

• fulfillment of obligations of INTERCAPITAL MARKETS AD according to instructions and orders of state bodies or persons performing public functions (e.g. FSC, BSE, CPDP, NRA, NSSI, State Agency for National Security Agency, municipalities, courts, private enforcement agents and others.);
• fulfillment of other regulatory obligations of INTERCAPITAL MARKETS AD provided in the Markets in Financial Instruments Act, Delegated Regulation (EU) 2017/565, LMML, the Accounting Act, the Tax and Social Insurance Procedure Code, The Commercial Law as well as the fulfillment of all other obligations of INTER INTERCAPITAL MARKETS AD, provided in the current European and national legislation.

THE REASON THAT GIVES US THE RIGHT TO PROCESS YOUR DATA IS:

Execution of contract

The processing of your data is necessary to take steps to enter, as well as to fulfill the contractual relations with you, including the provision of investment services.

Legal obligation of the administrator

The processing of your data is also necessary in order to comply with our legal obligations under the Financial Instruments Markets Act, Delegated Regulation (EU) 2017/565, the LMML, the Accounting Act, the Tax and Social Insurance Procedure Code, the Commercial Code law, as well as to fulfill all our other obligations as provided for in current European and national legislation.

Legitimate interest of the administrator

In some cases, we process personal data based on our legitimate interests, only if such processing does not affect your fundamental rights and freedoms.

For example, based on our legitimate interests, we provide our clients with additional information about the products and services they already use.

Based on our legitimate interests in establishing, filing and defending legal claims, as well as providing the necessary documents to clarify a possible legal dispute, we store personal data files for which no special minimum period has been provided, until the expiry of the limitation periods specified in the Law on Obligations and Contracts.

Consent

Based on your consent, INTERCAPITAL MARKETS AD may send you notices, news, notices, advertising and marketing messages regarding the provided investment products and services.

VOLUNTARY PROVISION

We process your personal data in order to provide the products or services for which an agreement with you is or has already been reached, for the fulfillment of our regulatory obligations and for the purposes for which your explicit consent has been obtained.

In case of refusal to provide personal data, INTERCAPITAL MARKETS AD may be unable to conclude or fulfill obligations under a contract already concluded with you.

Upon withdrawal of the consent to receive notices, news, notifications, advertising and marketing messages regarding the provided investment products and services, INTERCAPITAL MARKETS AD will stop processing your data for these purposes.

WHICH EXTERNAL ORGANIZATIONS/ PERSONS HAVE THE RIGHT TO RECEIVE PERSONAL DATA PROCESSED BY US?

We do not disclose your personal data to external organizations/ persons before making sure that the processing complies with the applicable European and national data protection laws, strictly controlling whether the processing is carried out subject to the legal basis and subject to technical and organizational data protection measures.

The reason for providing personal data is the fulfillment of a legal and contractual obligation.

We may provide personal data to some of the following categories of recipients:

• to authorities, institutions and persons in respect of which we are obliged to provide personal data under the applicable legislation (FSC, BSE, Central Depository, CPDP, NRA, NSSI, National Security Agency, municipalities, courts, private enforcement agents, etc.);

• counterparties who have committed to confidentiality in the performance of legal or contractual obligations, subject to applicable data protection legislation, including:

      o persons providing services as a bound agent;

TRANSFER OF PERSONAL DATA TO A COUNTRY OUTSIDE THE EU

We do not provide your personal data to non-EU countries.

Each transmission will be made in accordance with the requirements of the General Data Protection Regulation: subject to an adequate decision by the European Commission, subject to appropriate guarantees or binding company rules approved by the competent authority.

Outside the above cases, INTERCAPITAL MARKETS AD may provide your personal data to non-EU countries only if you have given your consent or the transmission is necessary for the conclusion/ execution of contracts between you and INTERCAPITAL MARKETS AD or contracts concluded in your interest.

DATA RECORDING PERIOD

INTERCAPITAL MARKETS AD only processes your personal data for the period necessary to achieve the purpose for which they were collected.

Upon completion of the purpose, we cease processing the data, exceptionally storing them until the finalizing all financial relations, subject to a legitimate interest and/ or expiration of the statutory terms provided for in the current legislation: Markets in Financial Instruments Act, Delegated Regulation ( EU) 2017/565, LMML, Accounting Act, Tax Procedure Code, Commercial Law, Value Added Tax Act, Law for obligations and contracts and other laws, in which is provided a minimum period for storage or exercising legal claims.

For example: INTERCAPITAL MARKETS AD is legally obliged to storage data and information of its clients for a period of 5 years in accordance with the requirements of the LMML and the Markets in Financial Instruments Act, and for a period of up to 10 years data of clients in accordance with the requirements of the tax and accounting legislation.

Other documents with personal data for which no minimum statutory period of storage is provided shall be kept until the expiry of the statutory limitation periods for filing legal claims (three or five years depending on the type of the claim) with a view to the legitimate interest of INTERCAPITAL MARKETS AD for the establishment, filing and defense of legal claims, as well as the provision of the necessary documents for clarifying the legal dispute.

In case of changes in the applicable legislation concerning the above terms, we INTERCAPITAL MARKETS AD will comply with the applicable regulatory requirements.
